    • 1. Acceptance of Terms

    By installing, accessing, or using the Kanban Flow Metrics Jira app ("the App"), you agree to be bound by this End User License Agreement ("EULA"). If you do not agree, do not install or use the App.

    2. App Description

    The Kanban Flow Metrics Jira app automatically calculates and displays Lead Time and Cycle Time flow metrics for Jira projects, providing configuration management, batch processing, reporting, and alert capabilities.

    3. License Grant

    3.1 License Scope

    We grant you a limited, non-exclusive, non-transferable, revocable license to:

    • Install and use the App within your Jira Cloud instance

    • Access and use the App's features and functionality

    • Configure and customize the App within its intended functionality for your project needs.

    • Generate reports and export data through the App

    3.2 License Restrictions

    You may not:

    • Copy, modify, or create derivative works of the App

    • Reverse engineer, decompile, or disassemble the App

    • Remove or alter proprietary notices

    • Use the App for illegal or unauthorized purposes

    • Transfer or sublicense your rights under this EULA

    • Violate Atlassian's terms of service

    4. User Responsibilities

    4.1 Acceptable Use

    You agree to:

    • Use the App only for its intended purpose

    • Comply with all applicable laws and regulations

    • Maintain the security of your Jira account

    • Not use the App to store or transmit malicious code

    4.2 Data Management

    You are responsible for:

    • Ensuring you have the right to use any data processed by the App

    • Backing up your data and configurations

    • Managing user access and permissions appropriately

    • Complying with your organization's data policies

    5. Intellectual Property Rights

    5.1 Our Rights

    The App and all related intellectual property rights remain our exclusive property.

    5.2 Your Rights

    You retain ownership of:

    • Your data and configurations

    • Custom reports generated using the App

    • Your intellectual property input into the App

    5.3 Feedback

    If you provide feedback about the App, you grant us a non-exclusive, perpetual, royalty-free license to use such feedback for the purpose of improving our products and services.

    6. Privacy and Data Protection

    The App processes data in accordance with our Data Security and Privacy Statement, which is incorporated by reference into this EULA.

    7. Disclaimers and Limitations

    7.1 No Warranties

    THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, EXCEPT TO THE EXTENT SUCH WARRANTIES CANNOT BE EXCLUDED BY LAW.

    7.2 Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM THE USE OF OR INABILITY TO USE THE APP.

    7.3 Maximum Liability

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE USE OF THE APP SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

    THIS LIMITATION SHALL NOT APPLY TO CLAIMS ARISING FROM OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, TO THE EXTENT SUCH EXCLUSION IS NOT PERMITTED BY LAW.

    8. Indemnification

    You agree to indemnify, defend, and hold harmless the App developer from any third-party claims, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the App, or your violation of this EULA.

    9. Termination

    9.1 Termination by You

    You may terminate by uninstalling the App or discontinuing use.

    9.2 Termination by Us

    We may terminate immediately if you breach this EULA or if required by law.

    9.3 Effect of Termination

    Upon termination, your license ceases and we may delete your data.

    10. Updates and Modifications

    10.1 App Updates

    We may update the App to improve functionality, fix issues, or add features.

    10.2 EULA Updates

    We may modify this EULA at any time. Material changes will be communicated to you via Atlassian Marketplace notifications or in-app alerts.

    11. Third-Party Services

    The App integrates with Atlassian services. Your use is subject to Atlassian's terms of service.

    12. Miscellaneous

    12.1 Entire Agreement

    This EULA constitutes the entire agreement between you and us regarding the App.

    12.2 Severability

    If any provision is invalid, the remaining provisions shall continue in effect.

    12.3 Force Majeure

    We shall not be liable for failures due to circumstances beyond our control.
