    • 1. Acceptance of Terms

    By installing, accessing, or using Comments Pulse for Jira (the "App"), you agree to be bound by this End User License Agreement ("EULA"). If you do not agree to this EULA, do not install or use the App.

    2. App Description

    Comments Pulse is a Jira Cloud app that helps users read, search, filter, and reply to Jira work item comments more efficiently. The App provides flat and threaded comment views, author and mention filtering, keyword search, and in-context comment and reply creation within the Jira work item activity experience.

    3. License Grant

    3.1 License Scope

    We grant you a limited, non-exclusive, non-transferable, revocable license to:

    • Install and use the App within your Jira Cloud instance

    • Access and use the App's features and functionality

    • Configure and use the App within its intended functionality for your team's workflow needs

    • Generate, view, and export content or results made available through the App

    3.2 License Restrictions

    You may not:

    • Copy, modify, or create derivative works of the App

    • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App, except where such restriction is prohibited by applicable law

    • Remove or alter any proprietary notices or labels

    • Use the App for illegal, harmful, fraudulent, or unauthorized purposes

    • Transfer, sublicense, lease, rent, sell, or otherwise distribute your rights under this EULA

    • Use the App in any way that violates Atlassian's terms, policies, or applicable platform requirements

    4. User Responsibilities

    4.1 Acceptable Use

    You agree to:

    • Use the App only for its intended business or collaboration purposes

    • Comply with all applicable laws, regulations, and third-party rights

    • Maintain the security of your Jira and Atlassian accounts

    • Not use the App to store, submit, or transmit malicious code or harmful content

    4.2 Data Management

    You are responsible for:

    • Ensuring you have all necessary rights and permissions to use any data processed by the App

    • Backing up your own data and configurations where appropriate

    • Managing user access and permissions appropriately within Jira and your organization

    • Complying with your organization's data governance, retention, and security requirements

    5. Intellectual Property Rights

    5.1 Our Rights

    The App, including all related software, content, design, branding, and intellectual property rights, remains our exclusive property or the property of our licensors.

    5.2 Your Rights

    You retain ownership of:

    • Your data and configurations

    • Your comments, replies, and other content submitted through Jira

    • Your internal reports, workflows, and other materials created through your use of the App

    5.3 Feedback

    If you provide suggestions, ideas, feedback, or recommendations about the App, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, and incorporate such feedback for the purpose of improving our products and services, without compensation to you.

    6. Privacy and Data Protection

    The App processes data in accordance with our Data Security and Privacy Statement, as updated from time to time, which is incorporated into this EULA by reference.

    7. Disclaimers and Limitations

    7.1 No Warranties

    THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT, EXCEPT TO THE EXTENT SUCH WARRANTIES CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

    7.2 Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS, GOODWILL, OR USE, ARISING OUT OF OR RELATED TO THE APP OR YOUR USE OF, OR INABILITY TO USE, THE APP.

    7.3 Maximum Liability

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP OR THIS EULA WILL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE APP DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

    THIS LIMITATION DOES NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW, INCLUDING LIABILITY ARISING FROM GROSS NEGLIGENCE OR WILLFUL MISCONDUCT TO THE EXTENT SUCH LIMITATION IS PROHIBITED.

    8. Indemnification

    You agree to indemnify, defend, and hold harmless the App developer and its affiliates, officers, directors, employees, and agents from and against any third-party claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the App, your content, or your breach of this EULA or applicable law.

    9. Termination

    9.1 Termination by You

    You may terminate this EULA at any time by uninstalling the App or discontinuing all use of the App.

    9.2 Termination by Us

    We may suspend or terminate your rights under this EULA immediately if you breach this EULA, if continued provision of the App becomes unlawful, or if required by law, regulation, or Atlassian platform requirements.

    9.3 Effect of Termination

    Upon termination, your license to use the App ends immediately, and you must stop using the App. We may delete App-related data that we store, subject to applicable law, operational requirements, and our data retention practices.

    10. Updates and Modifications

    10.1 App Updates

    We may update, enhance, modify, or discontinue all or part of the App at any time to improve functionality, address security issues, fix defects, maintain compatibility, or add new features.

    10.2 EULA Updates

    We may modify this EULA from time to time. If we make material changes, we may provide notice through Atlassian Marketplace, the App interface, or other reasonable means. Your continued use of the App after the updated EULA becomes effective constitutes your acceptance of the revised EULA.

    11. Third-Party Services

    The App is designed to work with Atlassian and Jira Cloud services and may rely on third-party platforms, infrastructure, or integrations. Your use of those services is governed by the applicable third-party terms, including Atlassian's terms and policies.

    12. Miscellaneous

    12.1 Entire Agreement

    This EULA constitutes the entire agreement between you and us regarding the App and supersedes any prior or contemporaneous understandings relating to its subject matter.

    12.2 Severability

    If any provision of this EULA is held to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

    12.3 Force Majeure

    We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including failures of third-party services, internet outages, labor disputes, natural disasters, governmental actions, or platform outages.
